PARTICIPATING IN THE MEDWAY VOLUNTEER NETWORK
TERMS AND CONDITIONS
a.Delivery of the Medway Volunteer Network (MVN) is supported by Medway Voluntary Action (Registered Charity no: 1042475). Policies and Procedure in relation to the operational activities of Medway Voluntary Action are available on request.
b.A key purpose of the MVN is to provide a platform for organisations to promote and engage with individuals with regards to volunteering opportunities they have available.
c."You" means You as the user (individual or organisation) of the Medway Volunteer Network.
d.The use of the term “content” relates to any information, images, comments, web links and other data displayed through the MVN.
e.You should read all the Terms and Conditions prior to participating in the MVN. If You do not agree to these Terms and Conditions, You should not use the MVN.
2.Information (‘Content’) posted through the MVN
b.Information, images, comments, links to opportunities and other content displayed through the MVN, are not intended as advice and should not be relied upon as such.
c.If You find any content on the MVN to be in any way offensive, obscene, defamatory, racist, harmful, inaccurate, unlawful, illegal or deceptive in any way, please notify Medway Voluntary Action (email: email@example.com phone: 01634 812850). On receipt of Your complaint Medway Voluntary Action will investigate and remove content if required.
d.Although we have no obligation to moderate content on this Website, we reserve the right to monitor any information transmitted or received through our Website. We reserve the right to reject, block, suspend or remove Your Content at any time and at our sole discretion, including in response to any complaints or objections received by Users or any other party in respect of Your Content. We in no way guarantee that Your Content or any part of it will be displayed on the Website.
3.Individuals participating in the MVN
a.As stated in (2c) above, information posted through the MVN is not intended as advice and should not be relied upon as such.
b.Organisations promoting their volunteering opportunities through the MVN are asked to adhere to the terms set out in 4 and 5 below. Whilst the MVN, and Medway Voluntary Action, encourage and support best volunteer practice within organisations we cannot be held responsible their behaviour.
c.If you’re unhappy with the treatment you receive whilst volunteering with an organisation participating in the MVN, then you should immediately report your concerns to that organisation. Should you be unhappy with their response, the MVN also holds a Complaints Policy for volunteers – a copy of which can be obtained from Medway Voluntary Action (email: firstname.lastname@example.org phone: 01634 812850)
d. When subscribing to the MVN Bulletin you are confirming that you are happy for MVA to contact you about volunteering and any volunteering opportunities that you may have taken up.
e.Under UK law people aged under-18 years are still defined as a ‘child’, and anyone who has involvement with them have important safeguarding requirements that they must adhere to. Therefore, some organisations have set age limits for their volunteers, so you should always check this with them.
4.Organisations participating in the MVN
a.You should be a registered charity or not-for-profit organisation.
b.Your organisation should have Policies and Procedures in place in relation to Safeguarding, Health and Safety, Equality and Diversity and any other(s) relevant to nature of your organisation’s activities.
c.Your organisation must value the involvement of volunteers, and Your volunteers should find their experience with You positive and rewarding. You should have appropriate Volunteer Policy and Procedures in place to achieve this goal. Should any volunteer supporting your organisation have a complaint, you should hold a Complaints Policy to respond to this. The MVN also holds a Complaints Policy for volunteers should they be unhappy with Your organisation’s response – a copy of which can be obtained from Medway Voluntary Action (email: email@example.com phone: 01634 812850)
d.You should hold appropriate insurances for your organisation that should include volunteers.
e.Volunteering opportunities advertised through the MVN will expire 60 days after posting via the MVA website. An extension can be requested by emailing firstname.lastname@example.org
f. When posting content through the MVN you are confirming that you are happy for MVA to contact your organisation about volunteering and any volunteering opportunities that have been taken up.
g.By posting content through the MVN You are confirming that Your organisation complies with all of the above.
5.Content uploaded to the MVN
a.Your Content must:
i.be accurate where it states facts;
ii.contain genuinely held views where it states opinions; clearly disclose any trade or professional relationship between You and the goods or services which are the subject of Your Content; and
iii.comply with UK laws
b.Your Content must not:
i.promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
ii.contain any material which is defamatory of any other person;
iii.infringe any copyright, database right or trade mark of any other person;
iv.contain misleading or deceptive statements or omissions or misrepresent Your identity or affiliation with any person;
v.contain any material which is obscene or offensive in Medway Voluntary Actions’ opinion;
vi.promote religious or political beliefs;
vii.be likely to harass, upset, embarrass, alarm or annoy any other person;
viii.contain any unsolicited or unauthorised advertising, promotions, junk mail, spam, chain letters, or other forms of solicitation or advertisement commercial or otherwise, including but not limited to the promotion of religious beliefs in an unsolicited manner;
ix.be likely to disrupt Medway Voluntary Action’s service in any way;
You agree to compensate us and our respective trustees/directors, officers, employees, volunteers and applicable third parties in full from and against all third party claims, liabilities, losses and expenses (including reasonable legal fees) suffered by such persons arising out of, or related to or which may arise from Your Content and/or any breach by You of any term of these Terms and Conditions.
a.To the fullest extent permissible by law, we exclude and disclaim all warranties, terms, conditions and representations that might otherwise be implied by law in relation to the MVN. In particular we do not represent or warrant that the MVN will be error-free, free of viruses or other harmful components, or that defects will be corrected. You must take Your own precautions in this respect.
b.We do not accept liability for any failure to maintain the MVN.
c.We shall not be liable, under these Terms and Conditions for any indirect, special, incidental or consequential damages or otherwise, even if advised of the possibility of such damages.
d.The content within the MVN may contain inaccuracies and typographical errors. We do not warrant the accuracy or completeness of this content.
e.The content within the MVN may contain inaccurate information about volunteering roles and opportunities and may include inaccurate information about organisations posting such roles and opportunities. We do not accept any liability for such inaccuracies and we do not warrant that all such content within the MVN is either genuine and we do not warrant the accuracy or completeness of such content.
f.We shall not be liable for any loss caused as a result of Your actions or inactions based on the content available through the MVN. However, nothing in these Terms and Conditions shall affect Your statutory rights, and nothing in these Terms and Conditions shall exclude our liability for:
death or personal injury arising through negligence;
fraudulent misrepresentation; and/or
anything else that cannot be excluded or limited by us under English law.
8.Jurisdiction and Applicable Law
The Courts of England & Wales will have exclusive jurisdiction over any claim arising from or related to participation in the MVN. English Law will apply to these Terms and Conditions.
